Frequently Asked Questions

Income Tax

Income Tax Returns & Tax Planning

When is the income tax return due?

If your accounts don't need an audit, the due date has generally been 31 July after the financial year ends. Audit cases have later dates. The government notifies – and sometimes extends – these dates, so the applicable date is confirmed each year.

My income is below the taxable limit. Should I still file?

Usually, yes. Filing lets you claim TDS refunds, carry forward losses, and keep a record that banks and embassies ask for. In some cases – large deposits, high foreign travel spend, large electricity bills – filing is compulsory regardless of income.

What happens if my return doesn't match my AIS?

The return may be processed with an adjustment, or you may get a notice asking you to explain. That's why the AIS is reconciled before filing, not after.

I missed the due date. What now?

A belated return can still be filed within the time the law allows, with a late fee and interest where applicable. Some benefits, like carrying forward certain losses, may be lost. After that, an updated return may be possible, with additional tax.

Which law applies to the return I'm filing now?

Returns for income earned up to 31 March 2026 are filed under the 1961 Act. The first returns under the 2025 Act will be for tax year 2026-27 – income earned from 1 April 2026.

Corporate Tax

When is a company's income tax return due?

Companies require an audit, so the return has generally been due by 31 October after the year ends, and later where transfer pricing applies. Dates are notified each year and are confirmed for you.

Should our company opt for the concessional tax regime?

It depends on the deductions and incentives you currently claim, any MAT credit you hold, and your plans. The option is generally irreversible once exercised, so it's worth a numbers-based comparison first.

Can you work alongside our in-house accounts team?

Yes. Most companies keep their books in-house; the tax workings, reviews and filings are handled with your team, not instead of it.

Income Tax Notices & Appeals

I've received an income tax notice. What should I do first?

Don't ignore it. Check it's genuine using 'Authenticate notice/order' on the income tax portal, note the response date, and share it as early as possible so there's time to gather documents properly.

Can I get more time to reply?

An adjournment can be requested online with reasons, but it's at the officer's discretion. It should be asked for well before the due date and never relied on.

Will I have to visit the income tax office?

Usually not. Faceless proceedings run entirely online, and personal hearings, where allowed, are by video conference.

What if I disagree with the assessment order?

An appeal can be filed within the time the law allows – on time is critical. A stay of demand can also be requested while the appeal is pending, subject to conditions.

TDS & TCS Compliance

When does TDS have to be deposited?

Tax deducted in a month has generally been due by the 7th of the next month, with more time for March. Due dates are set by the rules and confirmed for your payments.

What if TDS was deducted but deposited late?

Interest is payable for the delay, and late returns attract a late fee. Continued default can lead to penalty. Depositing on time avoids all three.

I'm buying a flat from an NRI. What do I need to do?

TDS on purchase from a non-resident is worked out differently and is usually higher, unless the seller has a lower deduction certificate. You'll also need a TAN. The computation, payment and certificate are handled for you.

NRI & International Taxation

Does an NRI have to file a return in India?

Yes, if taxable Indian income is above the basic exemption limit. It's also worth filing to claim back excess TDS – which is common on property sales and interest.

Why is the TDS on my property sale so high? Can it be reduced?

TDS on payments to non-residents is deducted on the sale price at higher rates, unless the buyer receives a lower deduction certificate. That certificate can be applied for before the sale, based on your actual gain.

Can everything be done while I'm abroad?

Yes. Returns, certificates and department responses are all online. Documents are shared electronically and calls are scheduled across time zones.

Our company is paying a foreign consultant. What do we need?

The taxability of the payment has to be determined, TDS deducted at the right rate (treaty or domestic), and Form 15CA/15CB filed before the bank remits.

GST

GST Registration & Returns

When is GST registration compulsory?

When aggregate turnover crosses the threshold for your state and type of supply – and in some cases regardless of turnover, such as inter-state supply of goods, sales through e-commerce operators and casual taxable persons.

I'm a freelancer working for foreign clients. Do I need GST?

Once your aggregate turnover crosses the threshold, yes. Exports can then be made without paying IGST under a Letter of Undertaking.

What happens if I miss a GST return?

Late fee and interest apply, and later returns are blocked until it's filed. Prolonged non-filing can lead to cancellation – and your customers may lose their input tax credit.

How long does registration take?

With a complete application, registration is usually granted within the time the law prescribes. Physical verification or a clarification notice can add time.

GST Advisory, Notices & Refunds

How long do I have to reply to a GST notice?

The time is stated in the notice and is often 30 days or less. Extensions are discretionary, so the reply should start the day the notice arrives.

How long does a GST refund take?

The law sets timelines once a complete application is filed. Most delays come from deficiency memos, so claims are filed complete, with full documentation, the first time.

Can you look at a contract before we sign it?

Yes – who bears the GST, place of supply and credit eligibility are far easier to settle in a contract than in a dispute.

Audit & Assurance

Statutory Audit

Does a company with no business still need an audit?

Yes. Every company must have its accounts audited and file its financial statements and annual return with the Registrar, even with no transactions.

When should the audit be finished?

Audited accounts must be placed before the AGM, ordinarily held within six months of the year end. Planning starts well before that.

How is the auditor appointed?

The first auditor is appointed by the Board within 30 days of incorporation. After that, shareholders appoint the auditor at the AGM – generally for five years – and the appointment is filed with the Registrar.

We're moving to Ind AS. Can you help?

Audits are carried out under both Accounting Standards and Ind AS, including the additional disclosures and notes Ind AS requires.

Tax Audit

When is the tax audit report due?

One month before the return due date – in recent years, around 30 September. Dates can be notified or extended.

What if a required tax audit isn't done?

A penalty linked to turnover can be levied, in addition to the consequences of an incomplete return.

Can our statutory auditor do the tax audit too?

Yes. The statutory auditor of a company can also conduct its tax audit.

Internal Audit & Stock Audit

Which companies must have an internal auditor?

Listed companies, and unlisted public and private companies above prescribed thresholds of turnover, borrowings, paid-up capital or deposits. Others often appoint one voluntarily.

How is internal audit different from statutory audit?

Statutory audit gives shareholders an opinion on the financial statements. Internal audit works for management, on processes, controls and leakage.

Business & Corporate

Business Setup & Registrations

LLP or private limited company?

An LLP usually means lighter compliance and suits professional and closely held businesses. A private limited company suits founders planning to raise equity or issue ESOPs. The right answer depends on your plans.

How long does company registration take?

With complete documents and an approved name, usually a couple of weeks, depending on processing by the Ministry of Corporate Affairs.

Is there a minimum capital requirement?

Not at present for a private limited company or LLP. Capital is set by what the business actually needs.

ROC / MCA Compliance

What's the penalty for late ROC filing?

An additional fee for each day of delay, which adds up quickly. Prolonged non-filing can also lead to director disqualification and strike-off.

When are the annual forms due?

Company financial statements within 30 days of the AGM; the annual return within 60 days. LLP forms have their own dates. Your calendar tracks all of them.

Our company hasn't filed for years. Can it be fixed?

Usually, yes – pending returns can be filed with additional fees, and schemes or condonation may be available depending on status. The first step is a status check.

Accounting & Advisory

Accounting, Finalisation & Payroll

Which accounting software do you use?

Whatever you already run – most commonly Tally and SAP – so there's nothing to migrate.

Can bookkeeping be done remotely?

Yes. Documents are shared electronically and books are maintained on cloud software or via remote access.

Can you just finalise our accounts at year end?

Yes. Many businesses keep books in-house and need help only with closing entries, financial statements and notes. That's handled as a separate engagement.

Project Finance & CMA Data

What is CMA data?

Credit Monitoring Arrangement data is a standard set of financial statements, projections and ratios that banks use to assess working capital needs. It covers past, current and future years.

Can you help us get a loan?

The financial information banks need – CMA data, project reports, projections – is prepared for you. Chartered accountants in practice aren't permitted to arrange loans, so the application and credit decision remain with you and the bank.

How far ahead do projections go?

Usually the current year plus the next one to five years, depending on the facility and the bank's requirement.

Certifications

CA Certificates

What is a UDIN?

A Unique Document Identification Number a chartered accountant generates on the ICAI portal for every certificate or report signed. It lets anyone verify the document.

Can a certificate be issued without documents?

No. Figures are certified only after the records behind them are examined.
